Elton John and David Furnish, who are gay, appear with their children in the June 17, 2013 edition of US Weekly. Can a spouse whose partner is gay gain sole custody on those grounds? Would a heterosexual relative, such as a grandparent or sibling, be able to take custody from a child’s gay parents on those grounds? Does a spouse who comes out of the closet risk losing custody? There is no bright line in such circumstances. Even if a court believed that being raised with a gay or lesbian role model in sexual matters was bad for a child, other factors might favor that parent.
