Many of us are excited about the new season of “Dexter”. Those who are his fans look the other way when he puts bad guys or gals out of commission. But what if we discovered that our own spouse was a serial killer? Can knowledge of a spouse’s crimes be used to obtain a divorce? In Louisiana, the answer is probably no. Louisiana recognizes the spousal privilege. The spousal privilege allows one spouse to object to the other spouse’s disclosure of secrets and confidences. If a husband confesses to his wife that he has murdered his best friend, his wife may not offer that evidence against him unless he agrees. Conviction of a felony is grounds for divorce, but the commission of one is not.
