What if she decides to use a surrogate for reasons of age or health? In the children’s story, The Little Red Hen, the hen got to keep her loaf of bread because she planted the seed, watered it, harvested it, ground the flour, and baked it. Does a surrogate get to keep the baby if she decides not to give it up? In Louisiana, the answer is, under certain circumstances, “no”. A Louisiana statute allows a husband and wife to donate eggs and sperm to a surrogate who is a relative. They are that child’s biological parents as a matter of law.
