In Martin v. Martin, 2011 CA 2053 (La. App. 1st Cir. 6/8/2012), the Court of Appeal upheld the trial court’s refusal to terminate an ex-wife’s permanent alimony finding that she had not lived together with another man in the manner of married persons. Mr. Duet, Mrs. Martin’s lover, was not living in her home, kept no clothes or toiletries there, and had his own home at which he lived most of the time. While a sexual relationship was established, there was not enough proof to establish that Mr. Duet and Mrs. Martin were living together like man and wife.
